Trademarks
- Filing and Maintenance of Trademark
I file and prosecute the client’s trademark applications. - Successfully Represented Domain Owner in UDRP Proceeding
Client’s domains were the subject of dispute under the Uniform Domain Resolution Policy (UDRP). Despite the claim being made by a large international corporation, I successfully defended the primary domains on my client – allowing them to continue to use the mark to successfully build their business. - Protected a Small Non-profit’s Mark
A local dance company was challenged by a national organization claiming a right to the clients name and website domain. I determined that the challenger’s claims were of little merit and were barred as a result of their extended delay in making the claims. I forced the organization to drop its claims for my client to change its name and negotiated the sale of the domain name to the challenger. - Consulting with Private Label Hair Care Products Distributor
My client, a small hair-salon venturing into private labeled hair care products, needed assistance in choosing a mark. I consulted with the client regarding what makes a good mark and performed knock-out searches to advise them on which marks would be strongest in their market. - Assisting Foreign Trademark Owners
My client, a Canadian manufacturer, required assistance before the USPTO. I aided the client with his trademark application and served as its Domestic Representative during the prosecution process. - Starting up clothing manufacturers identity
My client, a start-up clothing manufacturer, needed advice concerning its use of foreign words as a trademark for the firm and to assist in drafting formation documents. I analyzed the use of the mark and performed knock-out searches for the trademark to advise them regarding the availability of the mark.
Copyright
- Copyrighting Computer Code
A computer software company was concerned that since its code was available as source code to its customers. I aided the client in filing the code with the US Copyright Office. - Resolution of Copyright Infringement and Contract Dispute
My client, a commercial photographer, was commissioned to take photographs for use on posters and coffee books. After reviewing the terms of the agreement, I determined that the contracting party had violated the terms of the agreement and had violated the photographer’s copyright by not providing proper attribution on the published photos. I quickly negotiated a resolution that addressed my client’s concerns. - Assisting in Negotiating Software Distribution Agreement
Client is insurance clearinghouse providing desktop software to its clients to facilitate transactions. I worked to develop and negotiate a license for the software that addressed the needs of the client and addressed everyone’s concerns.
Art & Entertainment
- Advising a Jazz Band
My client, a nationally know jazz band, was offered a recording contract with a major French recording label. I reviewed and advised the bands management concerning the agreement to help them understand the agreement and to consider clauses that should be modified. - Start-up Music Management
My, client, a start-up band management company, needed agreements to sign bands. I consulted with the client to discover how he wanted to structure the agreements and drafted contracts fro him to use when working with his clients. - Advising Touring Group on Management Issues
Nationally known band needed management assistance. I consulted with the band and determined that there needs were more in public relations. After locating suitable PR representation, I negotiate and drafted an agreement to protect the client’s rights and given them the best possible business deal. - Providing order to Punks
My client, a start-up punk label, needed business formation and initial agreements. After consulting with members, I created and filed the necessary formation documents. I then Advised them of standard recording provisions and drafted sample agreements for use in signing new bands. - Consulting with Documentary Film Maker
My client, a documentary and commercial film maker, had completed a film addressing a controversial position of a national religious organization. I reviewed the film prior to distribution for the purpose of identifying potential points of liability. I advised the client regarding recommended changes to reduce their liability risk upon the commercial release of the film. - Checking in on ASCAP and Fair Use
My client, a theatrical non-profit organization, needed advice concerning ASCAP and BMI licensing requirements. I listened to the client and provided them with the necessary information to determine what licensing was needed. - Resolution of Dispute of Compensation
My client, an interior mural painter, was hired to paint a mural in an individual’s home. After considerable time and effort was expended by the client, the painter was terminated and the party refused payment and refused to return copyright protected work materials. I negotiated with the home owners attorneys to resolve the dispute and to safeguard the return of the materials.
Technology
- Drafting Non-Compete Agreements for Technology Businesses
Business clients involved with technology issues needed agreements to protect intellectual property rights and to protect them from unfair competition by former contractors and employees. I have aided multiple companies in helping draft these agreements to meet their specific viewpoints concerning these issues, while protecting their interests. - Protecting Consultant’s Future Business
My client, a computer coding consultant with international recognition for his expertise, was contracted to provide high level services to a major software manufacturer. I negotiated the terms and conditions of his agreement (including non-compete and non disclosure agreements). I worked to ensure that he was fairly compensated and that his representation would not hamper his ability to compete against the company on future endeavors. - Website Start Up
My client, a website and text messaging service, needed to insure that the site was prepared to have visitors come to their website and sign-up for service. I performed a review of the website and provided relevant privacy policies, terms of use and advertising agreements.
